You may cancel this agreement within three (3) business days after signing the contract or receiving a copy of the contract. Cancellation must be submitted in writing before midnight of the third business day following the date of the agreement.

Advantage Construction Inc. invests significant time preparing estimates, coordinating inspections with building officials, communicating with insurance carriers, scheduling materials and labor, and coordinating subcontractors prior to the start of work. If the customer cancels the agreement without legal right to do so before construction begins, the contractor may be entitled to recover payment for work already performed, restocking charges for returned materials, the cost of materials that cannot be returned, and twenty percent (20%) of the repair price offered by the customer’s insurance provider.

If the customer cancels the agreement without legal right to do so after the contractor has started work, Advantage Construction Inc. may be entitled to payment for all work performed plus twenty percent (20%) of the agreement price as liquidated damages and not as a penalty.

Advantage Construction Inc. will provide the level of material quality specified in the insurance scope or project agreement. If the homeowner chooses materials that exceed the amount approved by the insurance carrier, the homeowner will be responsible for paying the difference in cost.

Material warranties on products installed during the project are provided directly by the product manufacturer and remain subject to the manufacturer’s terms, limitations, and conditions. Advantage Construction Inc. does not extend or modify manufacturer warranties.

Except where otherwise indicated in writing, Advantage Construction Inc. provides a labor installation or workmanship warranty for a period of two (2) years from the date the work is substantially completed.

The workmanship warranty applies only to defective installation performed by Advantage Construction Inc. and does not cover damage caused by events or conditions beyond the contractor’s control, including fire, severe weather events such as hail or wind, tornadoes or hurricanes, abuse, or work performed by others.

The workmanship warranty does not apply to normal wear and tear. Examples of normal wear and tear include weathering of materials, cracking caused by excessive heat or temperature changes, and movement or stress caused by soil conditions, drying, or cyclic wind loading.

If the purchaser defaults on payment for more than sixty (60) days after the balance becomes due, any applicable warranties may be considered void after written notice is provided to the homeowner.

If a warranty service visit is requested and the issue is determined not to be related to defective installation performed by Advantage Construction Inc., the homeowner may be responsible for a service charge and any costs associated with the repair.

Advantage Construction Inc. reserves the right to inspect and evaluate any claim, item, or dispute prior to any repairs or alterations being made. If repairs are completed without allowing the contractor the opportunity to review the issue, the right to make a warranty claim may be waived.

Advantage Construction Inc. maintains liability insurance to protect homeowners if property damage occurs due to negligent work performed by the contractor.

Advantage Construction Inc. is not responsible for damage that occurs during the normal course of construction when reasonable care is exercised. This may include minor cosmetic conditions such as scuffs on driveways from construction access, dents or scratches to gutters during roof access, or debris created during demolition or installation.

Advantage Construction Inc. is not responsible for damage caused by pre-existing structural conditions, prior construction defects, design deficiencies, or work performed by other contractors not associated with this agreement.

If hidden deterioration or damaged materials are discovered once construction begins and those conditions were not visible prior to the start of the project, the repairs will be addressed on a time and materials basis. If the work is part of an insurance claim, Advantage Construction Inc. may bill the insurer directly. If the insurer declines to cover the additional work, the homeowner will remain responsible for those costs.

The homeowner is responsible for obtaining any approvals required by a homeowner’s association, municipality, subdivision, or other governing authority related to product selections, materials, colors, or design choices used in the project.

Minnesota Statute 325E.66 prohibits contractors from paying, waiving, or rebating a homeowner’s insurance deductible. Homeowners are responsible for paying their insurance deductible as required by Minnesota law.

Federal law requires contractors performing renovation, repair, or painting work that disturbs painted surfaces in homes built before 1978 to follow lead-safe work practices designed to prevent lead dust contamination. Advantage Construction Inc. complies with the EPA Renovation, Repair, and Painting (RRP) Rule and provides homeowners with the required lead safety information pamphlet explaining these procedures.

Minnesota law provides statutory warranties related to residential construction and home improvement work. These statutory protections cover certain defects caused by faulty workmanship, defective materials, or major construction issues and apply for specific periods defined by Minnesota Statutes Chapter 327A.

Advantage Construction Inc. will perform all work in accordance with manufacturer installation specifications and applicable building codes.

Advantage Construction Inc. accepts the following forms of payment: cash or electronic funds transfer, personal or business checks payable to Advantage Construction Inc., wire transfers subject to applicable processing fees, credit card payments subject to a four percent (4%) transaction fee, ACH bank transfers subject to a one percent (1%) transaction fee, cashier’s checks or certified bank drafts, and insurance or mortgage checks endorsed by the homeowner with the appropriate authorization documentation.

Payment terms and project schedules are defined within the written contract between the homeowner and Advantage Construction Inc. All parties agree that the signed agreement and its supporting documents govern the scope of work, payment obligations, and project responsibilities.
